Informed consent is a necessary component of the ethical practice of surgery. Ideally, consent is performed in a setting conducive to a robust patient-provider conversation, with careful consideration of risks, benefits, and outcomes. For patients with medical or surgical emergencies, navigating the consent process can be complicated and requires both careful and expedited assessment of decision-making capacity. We present a recent case in which a patient in need of emergency care refused intervention, requiring urgent capacity assessment and a modification to (...) usual care. (shrink)

In this paper I argue that Turing’s responses to the mathematical objection are straightforward, despite recent claims to the contrary. I then go on to show that by understanding the importance of learning machines for Turing as related not to the mathematical objection, but to Lady Lovelace’s objection, we can better understand Turing’s response to Lady Lovelace’s objection. Finally, I argue that by understanding Turing’s responses to these objections more clearly, we discover a hitherto unrecognized, substantive thesis in his philosophical (...) thinking about the nature of mind. This article makes the political dimension of Gadamer's thought more explicit by examining the interplay of three concepts in his work: solidarity, friendship, and the other. Focusing primarily on certain post--"Truth and Method" writings, I argue that Gadamer's conception of solidarity has to do with historically contingent manifestations of bonds that reflect a civic life together of reciprocal co-perception. These bonds go beyond conscious recognition of observable similarities and differences and emerge from encounters among those who are, and remain, in (...) important ways other to each other. I make this case through an analysis of Gadamer's phenomenology of friendship and the crucial role of otherness in his accounts of both understanding and friendship. I suggest that Gadamer's political thought gives us a way of conceptualizing solidarity and otherness without making the other same or leaving the other completely other. (shrink)

Some commentators have worried that Descartes‘s ontological proof is a kind ofafterthought, redundancy, or even embarrassment. Descartes has everythingneeded to establish God as the ground of certainty by Meditation Three, so whybother with yet another proof in Meditation Five? Some have even gone so far asto doubt his sincerity.1Past literature on this topic is of daunting variety andmagnitude, dating back to the seventeenth century.2The current discussion hasfocused on Descartes‘s premises in relation to the coherence of his concept ofGod.3I wish to (...) take up this issue from a somewhat different tack, showing that Descartes‘s ontological proof actually involves a subtle change in the direction ofhis argument from a reflective to a recollective theory of innateness. In the FifthMeditation, Descartes does not simply expand on his previous discussion of God,which arose out of reflection on his self; rather, the ontological proof depends ona kind of recollection of God‘s being that could only be based on the causalpositivity, or ―power,‖ of His existence. God is the structural cause of our idea ofhim and thereby restricts the way in which we may think of Him, in the sameway as the essence of a triangle structurally determines the ways we must thinkof it.4We are not free to construct such ideas in any way we want, so there mustbe a cause, or a reason, that restricts such construction.The specific argument of Meditation Five, however, must be understoodin its larger context, for part of the structurally determined idea of God containsnecessary existence, which Descartes interprets in terms of causal power. Yet whileAnselm‘s dual argument is ultimately based on a negative intuition of God‘sbeing, described in the Monologion as that without which the world cannot be,Descartes‘s dual argument in Meditations Three and Five is based on a positiveintuition or recollection of God‘s being as a necessary structural restriction on our concepts of the world. Many who take a dismissive attitude towards metaphysics trace their view back to Carnap’s ‘Empiricism, Semantics and Ontology’. But the reason Carnap takes a dismissive attitude to metaphysics is a matter of controversy. I will argue that no reason is given in ‘Empiricism, Semantics and Ontology’, and this is because his reason for rejecting metaphysical debates was given in ‘Pseudo-Problems in Philosophy’. The argument there assumes verificationism, but I will argue that his argument survives the rejection of verificationism. The root (...) of his argument is the claim that metaphysical statements cannot be justified; the point is epistemic, not semantic. I will argue that this remains a powerful challenge to metaphysics that has yet to be adequately answered. (shrink)

The doctrine of the communication of natures has played a primarily descriptive role in the history of Christology, and so it is perhaps unsurprising that it has largely gone missing from contemporary theology. This is a serious oversight. But Karl Barth is a noteworthy exception to the reductionist trend, and he provides the Reformed tradition's most complete and substantive engagement with the communication of natures and its implications for dogmatic theology. Through a close reading of volume IV/2 of the Church (...) Dogmatics , this essay considers Karl Barth's vital emphasis upon the communicatio naturarum and the role it plays in his actualist Christology. Barth demonstrates that the traditional threefold communication (of attributes, graces, and operations) has material as well as formal importance. According to Barth, we see in Christ not the mere coincidence of two natures, nor an interpenetration, nor the transformation of one into the other – but mutual operation and interpretation, where divinity and humanity each acquires and has its determination in the other. Robert Elliot claims that the metaethical distinction between subjectivism and objectivism is unimportant in environmental ethics. He argues that because a sufficiently sophisticated subjectivist can accommodate all the intrinsic value an objectivist can, even in apparently problematic situations where humans either do not exist or do not have the relevant values, and because metaethical commitments fail to have any normative or motivational impact on rational debate, it makes no difference whether an environmental ethicist is a subjectivist or an objectivist. Elliot's (...) dismissal, however, is unjustified. As it turns out, objectivists argue differently from the way subjectivists do, are motivated differently from the way subjectivists are, and are able to make a greater range of intrinsic value claims than subjectivists are. If Elliot's arguments have any appeal at all, it is only because he blurs the fundamental metaethical distinction in the first place and defends a subjectivism so objectivist that it is almost unrecognizable as subjectivism. Daniel Bensaïd’s theoretical and political framework deserves to be habitually known in the English-speaking world. His philosophical work has a universal dimension, but because it was also the product of particular political upsurges and downturns, it is necessary to understand these particular political moments to thoroughly understand the universal scope and significance of his work. This paper will look at these political developments and pay particular attention to the crisis of the workers’ movement, strategy and Marxism.

J. Baird Callicott is well known in environmental philosophy for his attack on Christopher D. Stone's moral pluralism. Although his attack has drawn attention from critics and has been labelled problematic for various reasons, I argue that it fails entirely. Each of Callicott's three distinct criticisms proves to be not only weak on its own terms, but, perhaps surprisingly, as effective against Callicott's own communitarian position as it is against Stone's pluralist one. I show that Callicott's attack is not only (...) wholly ineffective in targeting Stone, but that even if it were so effective it would on every count be just as effective in targeting its own originator. It is most tempting to think of Fredric Jameson’s Archaeologies of the Future in utopian terms, as a contribution to the history of utopian philosophy represented by Theodor Adorno, Louis Marin and Herbert Mar- cuse, if not Hegel, Marx and Jameson himself. To trace the line of utopian ideas in their works is to be seduced by Jameson’s own project, which has, 1 since Marxism and Form , mapped the utopian continuities that exist between an assortment of Marxist writers. Marxism (...) and Form stands as a seminal beginning to Jameson’s utopian project, introducing the work of un- 2 translated German writers, including Walter Benjamin and Herbert Marcuse, to a generation of Anglophonic scholars. One reviewer went so far as to recommend the book to English-speaking Germans to clear up the muddy phrases of Gyorgy LukÆcs and Ernst Bloch, claiming that Jameson presented a much more articulate version of their ideas! There is no better demonstration of the recognition effected upon the Marxist corpus by 3 Jameson’s intellectual clarity than the conclusion to Aesthetics and Politics , in which the hostility between LukÆcs and Bloch is transformed into two sides of the same politics. Indeed, the very meaning of Jameson’s Marxism comes about from just such theoretical sublimations as these, as 4 disparate European projects are unified both intellectually and politically. The sheer synthetic power of Jameson’s writing makes it difficult to think about his writing in terms that aren’t Jamesonian, the range of his project transforming Marxist literary criticism into a totality. John Searle distinguished between weak and strong artificial intelligence (AI). This essay discusses a third alternative, mild AI, according to which a machine may be capable of possessing a species of mentality. Using James Fetzer's conception of minds as semiotic systems, the possibility of what might be called ``mild AI'' receives consideration. Fetzer argues against strong AI by contending that digital machines lack the ground relationship required of semiotic systems. In this essay, the implementational nature of semiotic processes posited by (...) Charles S. Peirce's triadic sign relation is re-examined in terms of the underlying dispositional processes and the ontological levels they would span in an inanimate machine. This suggests that, if non-human mentality can be replicated rather than merely simulated in a digital machine, the direction to pursue appears to be that of mild AI. (shrink)

If an agent believes that the probability of E being true is 1/2, should she accept a bet on E at even odds or better? Yes, but only given certain conditions. This paper is about what those conditions are. In particular, we think that there is a condition that has been overlooked so far in the literature. We discovered it in response to a paper by Hitchcock (2004) in which he argues for the 1/3 answer to the Sleeping Beauty problem. (...) Hitchcock argues that this credence follows from calculating her fair betting odds, plus the assumption that Sleeping Beauty’s credences should track her fair betting odds. We will show that this last assumption is false. Sleeping Beauty’s credences should not follow her fair betting odds due to a peculiar feature of her epistemic situation. (shrink)

The use of language models in Web applications and other areas of computing and business have grown significantly over the last five years. One reason for this growth is the improvement in performance of language models on a number of benchmarks — but a side effect of these advances has been the adoption of a “bigger is always better” paradigm when it comes to the size of training, testing, and challenge datasets. Drawing on previous criticisms of this paradigm as applied (...) to large training datasets crawled from pre-existing text on the Web, we extend the critique to challenge datasets custom-created by crowdworkers. We present several sets of criticisms, where ethical and scientific issues in language model research reinforce each other: labour injustices in crowdwork, dataset quality and inscrutability, inequities in the research community, and centralized corporate control of the technology. We also present a new type of tool for researchers to use in examining large datasets when evaluating them for quality. (shrink)

How should we respond to evidence when our evidence indicates that we are rationally impaired? I will defend a novel answer based on the analogy between self-doubt and memory loss. To believe that one is now impaired and previously was not is to believe that one’s epistemic position has deteriorated. Memory loss is also a form of epistemic deterioration. I argue that agents who suffer from epistemic deterioration should return to the priors they had at an earlier time. What if your peers tell you that you should disregard your perceptions? Worse, what if your peers tell you to disregard the testimony of your peers? How should we respond if we get evidence that seems to undermine our epistemic rules? Several philosophers have argued that some epistemic rules are indefeasible. I will argue that all epistemic rules are defeasible. The result is a kind of epistemic particularism, according to which there are no simple rules connecting descriptive and normative facts. (...) I will argue that this type of particularism is more plausible in epistemology than in ethics. The result is an unwieldy and possibly infinitely long epistemic rule — an Uber-rule. I will argue that the Uber-rule applies to all agents, but is still defeasible — one may get misleading evidence against it and rationally lower one’s credence in it. (shrink)

At the heart of Paul Ricoeur’s hermeneutic phenomenology of religion one discovers a commitment to the diversity of religious expression. This commitment is grounded in his understanding of the linguistic and temporal conditions of religious phenomena. By exploring his contribution to the debate concerning the so-called ‘theological turn’ in French phenomenology in relation to his studies of translation, this essay explores Ricoeur’s understanding of religious phenomenality where meaning is experienced as the simultaneous advance and withdrawal of an originary event in (...) the traces of its interpretations. With such an understanding of religious phenomenality, the way is opened for philosophy of religion to advance a more robust consideration of religious diversity and, therefore, to reconsider notions of universality better suited to the things themselves. The fine-tuning argument can be used to support the Many Universe hypothesis. The Inverse Gambler’s Fallacy objection seeks to undercut the support for the Many Universe hypothesis. The objection is that although the evidence that there is life somewhere confirms Many Universes, the specific evidence that there is life in this universe does not. I will argue that the Inverse Gambler’s Fallacy is not committed by the fine-tuning argument. The key issue is the procedure by which the universe with life (...) is selected for observation. Once we take account of the procedure, we find that the support for the Many Universe hypothesis remains. (shrink)

Whether metacognitive experiences should be considered evidence for or against cognitive phenomenology is controversial. In this paper I analyze one metacognitive experience, having a word at the tip of one’s tongue, and argue that this experience is an instance of cognitive phenomenology. I develop what I call a Cognitive view of tip-of-the-tongue (TOT) experience, supported by examining the prominent psychological explanation of tip-of-the-tongue states emerging from the science of language production, showing how psychological data suggests that the phenomenal character of (...) tip-of-the-tongue experiences is constituted in part by conceptual representations, from which it follows that tip-of-the-tongue experiences are instances of cognitive phenomenology. This view contrasts with metacognitive embodied affect views of tip-of-the-tongue experiences, and I provide several clarifications and challenges that defenders of these views would have to address to situate their views within the cognitive phenomenology debate. Ultimately, I conclude that the Cognitive view of TOT is better supported by empirical data, and comports better with introspection, in comparison to embodied affect views. (shrink)

Jonathan Weisberg (2010 ) argues that, given that life exists, the fact that the universe is fine-tuned for life does not confirm the design hypothesis. And if the fact that life exists confirms the design hypothesis, fine-tuning is irrelevant. So either way, fine-tuning has nothing to do with it. I will defend a design argument that survives Weisberg’s critique — the fact that life exists supports the design hypothesis, but it only does so given fine-tuning.

Many epistemological problems can be solved by the objective Bayesian view that there are rationality constraints on priors, that is, inductive probabilities. But attempts to work out these constraints have run into such serious problems that many have rejected objective Bayesianism altogether. I argue that the epistemologist should borrow the metaphysician’s concept of naturalness and assign higher priors to more natural hypotheses.

Hoping is an integral part of what it is to be human, and its significance for education has been widely noted. Hope is, however, a contested category of human experience and getting to grips with its characteristics and dynamics is a difficult task. The paper argues that hope is not a singular undifferentiated experience and is best understood as a socially mediated human capacity with varying affective, cognitive and behavioural dimensions. Drawing on the philosophy, theology and psychology of hope, five (...) modes of hoping are outlined: patient, critical, sound, resolute and transformative. The key aim of the paper is to illustrate how different modes of hoping are associated with different pedagogical strategies. Phrased differently, the paper seeks to delineate a range of pedagogies of hope. The phrase ‘pedagogy of hope’ is very much associated with critical theory—one thinks instantly of, for example, Paulo Freire, Henry Giroux or bell hooks. There are many pedagogies of hope, however, and an explicitly conservative text such as William Bennett’s Book of Virtues has as strong a claim to the title as Freire’s radical and utopian ideas. A broader argument, therefore, is that there is nothing inherently radical or subversive about a pedagogy of hope. Pedagogies of hope can serve to reproduce social relations as well as to transform them. (shrink)

This paper examines how the exercises offered to the young Socrates in the Parmenides can be understood as an educational practice, or a gymnastic that is prior to and instrumental for defining forms. To this end, I argue that the subject of the exercises given to Socrates can be understood as an open and indeterminate ‘one’, rather than a form per se. I show that the description of the gymnastic exercises, the demonstration of the hypotheses themselves, and the language concerning (...) the ‘one’, are consistent with an indeterminate subject ‘one’. Realist thinkers in political philosophy often criticize ideal theorists for neglecting or eliminating the fact of politics in their work. This is supposed to be problematic because we should never expect to overcome politics. Any theory that attempts to do so is said to be unrealistic, naïve, and impractical. Although much has been said in the dispute between realists and ideal theorists in recent years, this particular line of criticism, which should be distinguished from other criticisms of ideal theory, has (...) not been clearly or explicitly addressed by ideal theorists in the literature. I deal with this issue by examining the ideal theory of John Rawls, which has been a prominent target of realist criticisms. My aim is to see where politics exists, or might exist, in Rawls’s theory, and whether this politics satisfactorily answers to the various aspects of the realist’s critique. My analysis suggests that there may be no inherent or necessary conflict between ideal theory and real politics, after all. (shrink)

Using files declassified and released to Great Britain's National Archives, this article shows how Britain's domestic spy agency, MI5, recruited Louis de Wohl (1903-61), a flashy Hungarian astrologer and Christian writer to create horoscopes for Adolf Hitler during World War II. De Wohl was a controversial figure. His origin story does not check out. His MI5 handlers found him showy. And recent journalists dismiss him as a ‘persuasive fake’. Yet his pre-war fictions were adapted for cinema, his later theological novels (...) remain bestsellers, and his personal story deserves greater attention if we are to better understand Christian historical fiction's popularity. In Bradley, I offered an analysis of Sleeping Beauty and the Everettian interpretation of quantum mechanics. I argued that one can avoid a kind of easy confirmation of EQM by paying attention to observation selection effects, that halfers are right about Sleeping Beauty, and that thirders cannot avoid easy confirmation for the truth of EQM. Wilson agrees with my analysis of observation selection effects in EQM, but goes on to, first, defend Elga’s thirder argument on Sleeping Beauty and, second, argue (...) that the analogy I draw between Sleeping Beauty and EQM fails. BackgroundThere is much overlap among the symptomology of autistic spectrum disorders, obsessive compulsive disorders, and alexithymia, which all typically involve impaired social interactions, repetitive impulsive behaviors, problems with communication, and mental health.AimThis study aimed to identify direct and indirect associations among alexithymia, OCD, cardiac interoception, psychological inflexibility, and self-as-context, with the DV ASD and depression, while controlling for vagal related aging.MethodologyThe data involved electrocardiogram heart rate variability and questionnaire data. In total, 1,089 participant's data of ECG recordings of healthy resting (...) state HRV were recorded and grouped into age categories. In addition to this, another 224 participants completed an online survey that included the following questionnaires: Yale-Brown Obsessive Compulsive Scale ; Toronto Alexithymia Scale 20 ; Acceptance and Action Questionnaire ; Depression, Anxiety, and Stress Scale 21 ; Multi-dimensional Assessment of Interoceptive Awareness Scale ; and the Self-as-Context Scale.ResultsHeart rate variability was shown to decrease with age when controlling for BMI and gender. In the two SEMs produced, it was found that OCD and alexithymia were causally associated with autism and depression indirectly through psychological inflexibility, SAC, and ISen interoception.ConclusionThe results are discussed in relation to the limitations of the DSM with its categorical focus of protocols for syndromes and provide support for more flexible ideographic approaches in diagnosing and treating mental health and autism within the Extended Evolutionary Meta-Model. An eighty‐six–year‐old woman has had lifelong obsessive‐compulsive disorder. At times, it has been so severe that she has lost touch with reality and been psychotic. She is actively followed by a community mental health nurse. When she questions the patient about these, the patient simply suggests that her nephew must have “needed the money” for something. The nurse questions her repeatedly about this matter, but she refuses to give further details. The patient becomes quite upset whenever the nurse brings it up and states, “This is my money, and he wouldn't take it unless he needed it to help me.”Should the nurse challenge the patient's right to make her own financial decisions in order to avoid a risk of exploitation by her family members?
